Terms of Service
Ziezo Terms of Service
These Terms of Service apply to every use of the Ziezo app (app.ziezo.social, website ziezo.social). By creating an account, connecting a channel or using Ziezo in any other way, you accept them. This is an English translation of the Dutch gebruiksvoorwaarden; in case of differences, the Dutch version prevails.
1. Who we are and who Ziezo is for
Ziezo is a product of Moof grafisch ontwerp Comm.V, Steenland 46, 8930 Rekkem, Belgium, company number BE 0833.354.120, hereafter "Moof", "we" or "Ziezo". You can reach us at welkom@ziezo.social.
Ziezo is intended for professional use by companies, self-employed persons, associations and organisations, hereafter "the customer" or "you". Whoever creates an account on behalf of an organisation declares to be authorised to represent that organisation and also binds it. You must be at least 18 years old to create a Ziezo account.
These terms take precedence over any terms of the customer, unless agreed otherwise in writing.
2. What Ziezo does, and what it does not do
Ziezo helps you prepare social media posts, write or improve them with AI, schedule them and publish them through connected channels. Ziezo only publishes posts that you (or someone in your workspace) created, approved or scheduled. Every publication therefore happens in your name, on your instruction and under your responsibility.
Moof is not a publisher, editor or adviser of your content. We do not check in advance what you upload or publish, and we are not obliged to.
3. Your account, real identity and no fake accounts
- You use your real name or company name and an email address you control. You keep your details correct and up to date.
- Fake, misleading or impersonating accounts are prohibited. You do not pretend to be another person, company or brand, and you only connect pages, profiles and accounts that are yours or that you are demonstrably allowed to manage.
- There is one free trial per organisation. Starting a new trial with another email address, alias or name to circumvent trial limits is not allowed. If we find this, we may merge or block the accounts or charge the usage at the applicable rate.
- You keep your password and login codes secret. Everything that happens through your account counts as done by you. If you notice abuse, report it to us immediately.
- We may ask you to prove your identity or your right to manage a channel, and refuse, suspend or close an account in case of reasonable doubt.
4. Your content: you hold the rights, you carry the responsibility
"Content" is everything you upload, enter, have generated or publish in Ziezo: photos, videos, logos, texts, hashtags, links, music and the like. You remain the owner of your content. You guarantee that:
- you hold all necessary rights to the content you use, such as copyright, trademark rights and licences, or the written permission of the rights holder;
- you have permission from every recognisable person in a photo or video to use and publish the image (image rights). For minors, you have the permission of their parents or guardian. This applies equally to staff, customers and passers-by;
- your content does not contain personal data of others, unless you have a valid legal basis under privacy law (GDPR);
- your content is not unlawful, misleading, defamatory, discriminatory, hateful, violent, pornographic or otherwise harmful, and does not constitute an unfair commercial practice or misleading advertising;
- your content complies with the rules of every platform you publish on, and with the legal rules for your sector, such as rules on price indication, promotions and contests, health claims, alcohol, influencer marketing and comparative advertising.
Moof does not check these rights and permissions and cannot be held liable for them. Keep proof of the permissions you received yourself.
5. AI texts and AI images
Ziezo uses artificial intelligence from external providers to create or edit texts, image descriptions, brand profiles and images. AI makes mistakes. Results can be incorrect, incomplete, outdated or inappropriate, and may accidentally resemble existing work of others.
- You read and check every suggestion before you approve or schedule it. By approving or scheduling, you make the text and image your own publication.
- Moof does not guarantee that AI content is correct, unique or free of third-party rights, and is not liable for the consequences of its use.
- You do not use AI to imitate existing persons or show them in a false context (deepfakes), and you disclose that content was made or edited with AI when the law or the platform requires it.
- What Ziezo summarises about your website or brand in a brand profile is an aid, not a factual statement. Check it.
6. Prohibited use
You may not use Ziezo to:
- send spam, mass messages or fake engagement, or circumvent the rules of a platform;
- distribute content that infringes the rights of others, or that is illegal, deceptive or harmful;
- copy, reverse engineer, scrape, overload Ziezo, or test or circumvent its security;
- resell, rent out or offer Ziezo as a service to third parties without our written permission;
- run political advertising or election campaigns, unless you comply with all legal and platform obligations for it yourself.
7. Third-party platforms (Meta, Instagram, LinkedIn, TikTok and others)
Publishing happens through the integrations offered by platforms such as Meta (Facebook and Instagram), LinkedIn and TikTok. Your use of those platforms is subject to their own terms and rules, which you comply with yourself. When you connect TikTok, the TikTok Terms of Service and Community Guidelines apply to everything Ziezo uploads to your TikTok account on your instruction. Ziezo uploads videos to your TikTok account as a draft; you review and post them in the TikTok app yourself.
These platforms may change, limit or end their integrations, rules, reach or access at any time, refuse or remove posts, and block accounts. Moof has no influence on this and is not liable for posts that are not published, published late, twice or differently due to an error or decision of a platform, an expired connection or an interruption.
8. What we may do with your content
You grant Moof a limited, non-exclusive, free permission to store, process, edit at your request, send to AI providers and the platforms you choose, and publish your content, to the extent needed to provide Ziezo to you. We do not use your content for our own advertising, nor to train our own AI models, unless you explicitly agree.
Ziezo itself, including the software, design, name and logo, remains the property of Moof. You only receive a personal, non-transferable right of use as long as your account is active.
9. Privacy and processing of personal data
How Moof handles your account data is described in the Ziezo Privacy Policy. For personal data contained in your content (for example people in photos, names in texts), you are the controller and Moof acts as processor. For that processing, the following serves as a data processing agreement:
- Moof only processes that data on your instruction and to provide Ziezo;
- everyone at Moof with access is bound by confidentiality;
- Moof takes appropriate technical and organisational security measures;
- Moof engages sub-processors for hosting, storage, backups, email, payments and AI, as listed in the privacy policy, and imposes similar obligations on them. By using Ziezo you agree to this;
- Moof reasonably assists you with requests from data subjects and reports a data breach affecting your data without undue delay;
- after your account ends, Moof deletes the data, except what we are legally required to keep.
You make sure you have a valid legal basis for the data you use in Ziezo, and that you inform the persons concerned correctly.
10. Trial, credits, subscriptions and payment
- The free trial lasts 14 days and has limits, such as a maximum number of posts and AI credits. After the trial, you can only continue using Ziezo with a paid subscription.
- A monthly subscription renews automatically every month and is paid through our payment partner Mollie, until you cancel it. You can cancel at any time, effective from the end of the current month.
- A yearly subscription is paid in advance for twelve months. It does not renew automatically: about one month before the end you receive a reminder, and you renew it yourself in Ziezo if you want to continue.
- Paid periods, used credits and purchased extra credits are not refunded, also not in case of early termination or lower use than expected. Credits have no monetary value, are not transferable and cannot be exchanged.
- All prices are in euro and exclude VAT, unless stated otherwise. We may change prices. For a running subscription, we announce a price change at least 30 days in advance. If you do not agree, you can cancel before the new price applies.
- In case of a failed or disputed payment, we may limit or suspend your account until everything is paid. For companies, late payment gives rise to the statutory interest and compensation under the Belgian law of 2 August 2002.
- If you nevertheless use Ziezo as a consumer, you keep all rights the law mandatorily grants you.
11. Availability, backups and your own copies
We do our best to make Ziezo work well, securely and without interruption, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, outages at our providers or platforms and force majeure may temporarily interrupt the service. Features may change, improve or disappear.
We make daily backups to be able to restore your data after a technical incident. We keep these backups for at most 30 days. Data you delete therefore also disappears from our backups within 30 days. Backups are not an archive service: we do not guarantee that every version of your content can be restored. Always keep your own copy of your original photos, videos and texts.
12. Liability
Ziezo is a tool. Moof has an obligation of means, not of result. To the extent permitted by law:
- Moof is not liable for your content and the consequences of publishing it, for AI suggestions you approved, for infringements of image rights, copyright, trademark rights or privacy by your content, for decisions or errors of platforms, or for fake or misused accounts of others;
- Moof is not liable for indirect damage, such as lost profit, lost revenue, reputational damage, loss of followers or reach, loss of data or missed opportunities;
- Moof's total liability per claim and per year is limited to the amount you actually paid to Moof in the 12 months before the claim, with a maximum of 500 euro;
- you must report a claim to us in writing within 3 months after you noticed the damage, otherwise it lapses.
These limitations do not apply in case of intent or fraud by Moof, nor to the extent the law prohibits a limitation, such as in case of death or personal injury.
13. Indemnification
You fully indemnify Moof, its managers, employees and subcontractors against any claim, fine, damages and costs (including reasonable lawyers' fees) of third parties, platforms or authorities arising from your content, your use of Ziezo, a breach of these terms or the law, or an infringement of third-party rights, including image rights, copyright, trademark rights and privacy. You cooperate in the defence and do not enter into a settlement binding Moof without our permission.
14. Reporting unlawful content
If you see content published through Ziezo that infringes your rights, such as a photo of yourself without permission, report it to welkom@ziezo.social with your name, the link, an explanation of the infringement and your contact details. This address is also our point of contact for authorities and users under the Digital Services Act. We handle reports as quickly as possible. We may remove content or block a connection or account while a report is being investigated, without being liable for it. Also remove the publication on the platform yourself, as Moof does not always have access there.
15. Suspension and termination
Moof may limit, suspend or end your access immediately and without prior notice, and remove content, if you breach these terms or the law, in case of suspected fraud or abuse, in case of non-payment, or if a platform or authority asks for it. You are then not entitled to a refund or compensation.
You can have your account closed at any time via welkom@ziezo.social. After your account ends, we delete your data within 30 days, except what we are legally required to keep. Download what you want to keep beforehand. Articles that by their nature continue to apply, such as liability, indemnification and governing law, remain in force after termination.
16. Force majeure
Moof is not liable for failures caused by circumstances beyond its reasonable control, such as outages or decisions of platforms, hosting or AI providers, internet or power outages, cyberattacks, government measures, illness and natural disasters.
17. Changes to these terms
We may change these terms. For important changes, we notify you at least 30 days in advance by email or in Ziezo. If you continue using Ziezo after the effective date, you accept the new version. If you do not agree, you can cancel before that date.
18. Governing law and competent court
These terms and any use of Ziezo are governed exclusively by Belgian law. In case of a dispute, we first look for a solution together. If that fails, only the courts of the judicial district of West Flanders, Kortrijk division, have jurisdiction. Mandatory rules giving a consumer the right to litigate before their own court continue to apply.
19. Final provisions
If a provision is invalid or unenforceable, the other provisions remain in force and we replace the invalid provision with a valid one that comes as close as possible to it. If we do not exercise a right immediately, this does not mean we waive it. You may not transfer your rights and obligations under these terms without our permission. Moof may transfer Ziezo and this agreement to another company. The Dutch version of these terms prevails.
